Workers in the state of Massachusetts and across the country have laws that protect them from retaliation in the workplace. However, this does not stop some employers from using such things as harassment or job termination as a form of retaliation. Full-time employees typically have certain benefits that can provide compensation for injuries suffered while on the job. Workers should not be punished for using these employment benefits, but that is what allegedly happened to a worker from another state. Now, she has filed a wrongful termination lawsuit against her former employer.
According to the lawsuit, the woman worked for an automobile manufacturing company and was terminated after she sought workers’ compensation benefits for work-related injuries. Allegedly, the woman suffered repetitive trauma while working, so she filed a workers’ compensation claim to offset the burden caused by her injuries. Because of this, the plaintiff claims that she was later retaliated against and discharged from her job.
The plaintiff alleges that the company failed to provide her with rightful compensation for her injuries and terminated her for exercising her rights as an employee. The plaintiff claims she suffered loss of benefits and income, as well as mental anguish due to her alleged wrongful termination. She is seeking a trial by jury and and damages in excess of $75,000.
Losing employment can be a difficult and traumatic experience. Fortunately, laws exist in the state of Massachusetts and throughout the United States that protect workers from retaliation and other unfair acts by employers. Damages awarded from a successful wrongful termination lawsuit could provide much-needed financial relief as well as a sense of justice.
