In the state of Massachusetts and across the country, employees have basic and established rights. Typically, a job is not only about the pay, but also about the benefits that come with employment. Most workers assume that employers understand labor laws and always follow them. All too often many employers, either knowingly or unknowingly, violate established employment laws. Recently, a worker in another state filed a wrongful termination lawsuit after his employer allegedly retaliated against the man for exercising his rights.
The plaintiff claims that he suffered an injury on the job. Because of the work-related injury, the plaintiff sought medical leave and other benefits, according to the lawsuit. The plaintiff asserts that he took medical leave per physician’s orders and, a few months later, was terminated from his position.
The plaintiff alleges that his former employer failed to provide him the right to medical leave and purposely fired him for seeking to exercise his rights. Because of this, the man claims he suffered emotional distress, as well as loss of income and benefits. The plaintiff is seeking damages in excess of $50,000 plus costs of the suit and any other relief the court deems appropriate.
Losing a job can be financially and psychologically devastating, especially when loss of employment occurs as the result of retaliation. Laws exist in the state of Massachusetts and at the federal level to protect workers from unfair acts in the workplace.
